Terms of Service for Isle Chef 4 You

Definitions

In these Terms of Service, the following definitions apply:

  1. “Event” refers to any occasion, gathering, or function for which the services of Isle Chef 4 You are contracted. This includes but is not limited to private dining experiences, corporate events, and other social gatherings.
  2. “Service” encompasses all forms of culinary and hospitality services provided by Isle Chef 4 You, including Chef Hire, Menu Planning, and Temporary Staffing, as well as any other related services as detailed in the Service Description section.
  3. “Client” refers to any individual, company, or entity that enters into a service agreement with Isle Chef 4 You. The Client is the recipient of the services provided.
  4. “Booking” is the act of reserving services provided by Isle Chef 4 You, which is confirmed upon mutual agreement between the Client and Isle Chef 4 You, as outlined in the Booking and Confirmation section.
  5. “Cancellation” refers to the termination of agreed services by either the Client or Isle Chef 4 You as detailed in the Cancellation Policy section.
  6. “Invoice” means the billing document issued by Isle Chef 4 You to the Client, detailing charges for services rendered or scheduled.
  7. “Deposit” is a sum of money paid in advance as part of the total payment to secure services, as outlined in the Payment Terms section.
  8. “Agreement” is the contractual arrangement between the Client and Isle Chef 4 You, governed by these Terms of Service.

1. Introduction

Isle Chef 4 You is an independent hospitality service provider on the Isle of Wight, specializing in chef hire for various events, menu planning for restaurants, and providing temporary staffing solutions.

2. Service Description

  • Chef Hire: Provision of chef services for business and private events.
  • Menu Planning: Assistance with restaurant menu development.
  • Temporary Staffing: Offering temporary staffing for hospitality needs.

3. Booking and Confirmation

  • Bookings are accepted via email, phone, or online.
  • Confirmation will be sent via email once both parties agree.
  • Bookings are subject to these terms and conditions.

4. Charges

  • Freelance Chef Services: £28.00 per hour, minimum 4-hour charge.
  • Private Dining Menus: Starting from £250.00 for 4 people.
  • Menu Consultation: £20.00 per hour.
  • Wedding Breakfast Menus: Starting from £35 per person.
  • Canape Menus: Starting from £2.50 per canape.

5. Payment Terms

  • Freelance Chef Services: An invoice will be issued for the date of commencement, hours worked will be calculated to the nearest quarter hour, payable within 7 days from invoice date.
  • Larger Events: A 20% non-refundable deposit is required upon booking confirmation. The full balance is due 30 days before the event.
  • Provisional Bookings: Held for 14 days, confirmed upon deposit payment. If another customer wishes to book the same date, the initial customer has 48 hours to confirm with a deposit.
  • Short Notice Bookings: Full charges will be invoiced upon confirmation of event details, payable within 7 days from invoice date. 
  • Payments via BACS: cash will be accepted with prior agreement.
  • Unpaid Invoices: Isle Chef 4 You reserve the right to charge interest on invoiced amounts unpaid by the due date at the rate of 2% per day.

6.Cancellation Policy

Freelance Chef Services:

  • Cancellation by Customer:
    • If a booking is canceled by the customer within 48 hours of the proposed start date, a charge equivalent to 4 hours of service will be incurred.
    • For cancellations within 24 hours of the proposed start date, the customer will be charged for the total hours that were scheduled for work.
  • Cancellation by Isle Chef 4 You:
    • Isle Chef 4 You reserves the right to cancel any scheduled services without liability.

Events/Private Dining:

  • Customer Cancellations:
    • The customer acknowledges that Isle Chef 4 You incurs costs in purchasing food, other consumables, and arranging equipment and hired labor, in advance of an event.
    • In the event of cancellation or reduction in the number of attendees, costs for food, consumables, hired equipment, and labor are non-refundable as they are expenses incurred in preparation for the event.
    • The standard notice for cancellation is 4 months. For cancellations with less than 4 months’ notice, charges will be as follows:
      • 11-16 weeks prior to the event: 55% of the final invoice.
      • 7-10 weeks prior to the event: 70% of the final invoice.
      • 3-6 weeks prior to the event: 85% of the final invoice.
      • 1-2 weeks prior to the event: 90% of the final invoice.
  • Cancellation by Isle Chef 4 You:
    • Isle Chef 4 You may terminate the agreement at any time and for any reason. In such cases, Isle Chef 4 You will return any deposit paid, which will constitute the full extent of our liability in the matter of cancellation. Isle Chef 4 You’s liability for any other costs, losses, or damages incurred by the client due to such cancellation is limited to the amount of the deposit paid.

7. Data Protection and Privacy

  • Customer data will be used for booking administration and, where consented, to inform of other services and events. We do not disclose customer details to third parties.

8. Additional Provisions

  • Liability and Indemnity: Liability for indirect or consequential losses is limited to the total value of the contract.
  • Force Majeure: We are not liable for failure to perform our obligations due to events beyond our control, including natural disasters.
  • Complaints and Dispute Resolution: Complaints must be reported within 7 days for prompt resolution.
  • Health and Safety Compliance: We strictly adhere to food safety and hygiene standards. 

9. Amendments and Updates

  • Isle Chef 4 You reserves the right to amend or update these Terms of Service at any time. Any changes will be communicated to our clients through our official communication channels. Continued use of our services after such changes will constitute acceptance of the new terms.

10. Governing Law and Jurisdiction

  • These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes or claims arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Severability

  • If any provision of these Terms of Service is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

12. Confidentiality

  • Both parties agree to keep any proprietary or sensitive information shared during the provision of services confidential, unless disclosure is required by law.

13. Accessibility and Inclusivity

  • Isle Chef 4 You is committed to ensuring that our services are inclusive and accessible to all clients. We endeavor to accommodate specific needs and requests to the best of our ability.

14. Feedback and Reviews

  • Client feedback is important to us. We may use client reviews and feedback in our marketing materials, unless specifically requested not to by the client.

15. Limitation of Liability

  • Isle Chef 4 You’s total liability for any and all direct damages, losses, or injuries arising out of or in connection with our services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, shall be strictly limited to the amount actually paid by the client to Isle Chef 4 You under the specific contract from which the claim arises.
  • In no event shall Isle Chef 4 You be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, even if Isle Chef 4 You has been informed of the possibility of such damages.
  • This limitation of liability applies to the fullest extent permitted by law and shall survive the termination or expiration of the contract or the provision of services.

16. Client Responsibilities

  • Clients are responsible for providing all necessary information and ensuring a safe and appropriate environment for the delivery of our services. Specific requirements or conditions for events should be communicated to us in advance.

17.Acknowledgment and Acceptance

By confirming your booking with Isle Chef 4 You, you acknowledge and agree to these terms and conditions.
